By accessing or using GradeUp, you agree to these Terms of Service (“Terms”). Please read them carefully before using our website and services. If you do not agree, you must not use our platform.

1) Our Services

GradeUp provides online, curriculum-aligned mathematics self-learning tools for Grades 3–10, including:

  • Interactive worksheets with instant marking,
  • Timed exam preparation tools,
  • Step-by-step video memos for each question,
  • Tutorial videos,
  • Automated parent progress reports.

All content is 100% online. Materials are not downloadable, printable, or provided as physical books.

2) Eligibility

  • The platform is intended for use by learners under the supervision of a parent/guardian.
  • By registering, purchasing, or using our services, you confirm you are at least 18 years old, or have parental/guardian consent.

3) Accounts

  • A parent/guardian account is required to purchase and manage access for learners.
  • You are responsible for keeping login credentials secure.
  • You must ensure learner use complies with these Terms.

4) Purchases & Subscriptions

We offer different payment models:

  • Once-off (term-based) packages with lifetime access for that content,
  • Monthly subscriptions (for certain products).

Payments

  • All payments are processed via PayFast, a secure third-party gateway. We do not store card details.
  • Prices are displayed in South African Rand (ZAR) and include applicable taxes.

Renewal & Cancellation (for subscriptions)

  • Monthly subscriptions renew automatically until cancelled.
  • You can cancel anytime through your account or by contacting us. Cancellation stops future billing but does not refund past payments.

5) Refunds

  • Once-off purchases: Non-refundable after access has been granted.
  • Subscriptions: Refunds are not provided for partial months or unused time.

If you experience a technical issue preventing access, please contact us within 7 days for assistance.

6) Use of Platform

You agree not to:

  • Share your login with unauthorised persons,
  • Copy, download, or distribute our videos, worksheets, or exams,
  • Use the platform for unlawful purposes,
  • Attempt to interfere with system security or availability.

We may suspend or terminate access if these Terms are breached.

7) Intellectual Property

  • All content, including videos, worksheets, memos, logos, and branding, is owned by Learn in Cloud (Pty) Ltd and protected by copyright and trademark laws.
  • You are granted a limited, non-transferable licence to use the content for personal, non-commercial educational purposes only.

8) Data Protection & Privacy

We process personal information in accordance with our Privacy Policy and POPIA. By using GradeUp, you consent to such processing.

9) Service Availability

  • We aim for uninterrupted service but do not guarantee availability at all times.
  • Access may be interrupted for maintenance, upgrades, or issues beyond our control (e.g., hosting, internet failures).

10) Limitation of Liability

To the fullest extent permitted by law:

  • GradeUp is provided “as is” without warranties of accuracy or fitness for purpose.
  • We are not liable for any indirect, incidental, or consequential damages.
  • Our total liability is limited to the amount paid by you for the service in the last 3 months.

11) Changes to Terms

We may update these Terms at any time. The latest version will be posted on our website with a “Last Updated” date. Continued use of the platform means you accept the updated Terms.

12) Governing Law

These Terms are governed by the laws of South Africa. Disputes will be subject to the jurisdiction of South African courts.
